Do not send ownership records, tax returns, account numbers, passport data, or other sensitive documents through the public form. Questions about foreign business and investment reporting

Are Forms 5471, 8858, and 8621 included with every international return?

No. They are separate information returns with different filer definitions, ownership rules, schedules, exceptions, and records. Each form, foreign entity or investment, and filing year must be reviewed and expressly included in the written engagement.

Is Form 5471 only for a majority owner of a foreign corporation?

No. The IRS instructions describe multiple filer categories, including certain officers, directors, shareholders, and U.S. shareholders under direct, indirect, and constructive ownership rules. The applicable category and schedules require a facts-based review.

Can one Form 8621 cover every foreign fund?

Generally, the IRS instructions call for a separate Form 8621 for each PFIC held directly or indirectly when a filing requirement applies. Exceptions and elections can change the analysis, so the investment and ownership records must be reviewed.

When are these forms filed?

Forms 5471 and 8621 generally attach to the applicable federal return, and Form 8858 attaches to the applicable return or related Form 5471 or 8865 as directed by its instructions. The filing date generally follows the due date, including extensions, of the connected return, but the exact filing path depends on the facts and current instructions.

Potentially, but delinquent international information returns, amended returns, reasonable-cause positions, penalty matters, and available correction procedures require a separate review. No correction method or penalty outcome can be assumed before the complete filing history and agency contact are evaluated.
