How is U.S. tax residency determined for a foreign national?

U.S. federal tax residency can involve the green-card test, substantial-presence test, applicable exceptions, elections, and treaty rules. The analysis is tax-specific and depends on dates and facts; it does not determine or change immigration status.

Will I file Form 1040 or Form 1040-NR?

That depends on U.S. federal tax residency and the tax year involved. A resident alien generally follows resident filing rules, while a nonresident alien who must file generally uses Form 1040-NR. Arrival, departure, elections, treaty positions, and exceptions can create a different or dual-status filing path.

Does owning U.S. rental property create a U.S. return requirement?

It can. Ownership, rental activity, elections, withholding, sale activity, entity structure, and current filing rules can affect the return and tax treatment. Federal and state rental-property work, property-sale reporting, and any entity return are separate unless included in writing.

Form W-7 coordination may be available when connected with an accepted U.S. tax filing and expressly included in the engagement. Tavella CPA Group does not claim Certified Acceptance Agent status or promise document authentication. Depending on the facts, original documents, issuing-agency-certified copies, an IRS Taxpayer Assistance Center, or a Certified Acceptance Agent may be required.

Will an income tax treaty eliminate the U.S. filing requirement?

Not automatically. Treaty eligibility depends on the treaty, residence, income type, status, dates, and required disclosures. A treaty benefit can still require a U.S. return or disclosure, and any treaty-based position must be specifically reviewed and accepted before it is included.

Does this service include immigration or foreign-country tax advice?

No. U.S. tax-return preparation does not include immigration advice, a legal opinion, or another country's tax return. Those matters require appropriately qualified professionals and are outside the engagement unless a limited coordination role is confirmed in writing.

How do I upload documents?

After engagement setup, use the secure client portal and the upload instructions provided by Tavella CPA Group. Do not send Social Security numbers, tax returns, bank information, or other sensitive documents through the public contact form or ordinary email.

Is this service cloud-based?

Yes. Organizers, secure document uploads, messages, electronic signatures, invoices, and final documents can be handled online through the appropriate secure workflow.

How long will preparation take?

Timing depends on the service, complexity, completeness of the information provided, filing deadline, and current availability. Expected timing is discussed when the scope is confirmed; submitting a consultation request does not reserve a filing deadline.
